User Agreement

Welcome to Heya! By accessing or using our mobile application ("App"), you agree to comply with and be bound by the following User Agreement ("Agreement"). Please read this Agreement carefully before using our services. If you do not agree with the terms and conditions of this Agreement, you must not use the App.

1. Acceptance of Terms

By creating an account, browsing, or using the Heya app, you acknowledge that you have read, understood, and agree to be bound by this Agreement, our Privacy Policy, and any other applicable terms and platform policies.

2. Eligibility

You must be at least 18 years old to create an account and use the App. By using the App, you represent and warrant that you meet this age requirement. If it is discovered that a user under 18 has created an account, that account will be terminated immediately.

3. Account Security

You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to immediately notify Heya of any unauthorized use of your account or any other breach of security.

4. Use of the App

You agree to use the App in a manner consistent with all applicable laws and regulations. You will not use the App for any unlawful or prohibited purpose, including but not limited to:

• Impersonating any person or entity.
• Harassing, threatening, stalking, or defrauding other users.
• Engaging in spamming, phishing, or other malicious activities.
• Attempting to gain unauthorized access to our systems or interfere with the proper functioning of the App.

5. User Generated Content (UGC) & Zero-Tolerance Policy

Heya allows users to interact and post content. You are solely responsible for any content you post or transmit through the App.

5.1 Absolute Prohibition of Objectionable Content

There is strictly zero tolerance for abusive users or objectionable content on Heya. You explicitly agree that you will not post, upload, transmit, or share any content that falls into the following categories of Objectionable Content:

• Defamatory or Abusive: Content that constitutes cyberbullying, harassment, threats of physical harm, or defamation against any individual or group.
• Sexually Explicit: Pornographic material, obscene imagery, or explicit adult content.
• Hate Speech: Content that promotes violence, discrimination, or hatred based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or age.
• Illegal Activity: Content that promotes or facilitates illegal acts, drug use, or intellectual property infringement.

5.2 Mandatory Safety Protocols

To ensure user safety, Heya provides the following built-in features which all users are encouraged to use:

• Filtering: The App implements automated keyword and content filtering to prevent obvious slurs and explicit text from being posted.
• In-App Flagging/Reporting: Every piece of content features a prominent "Flag" or "Report" mechanism. Users can instantly flag any content they deem objectionable.
• In-App Blocking: Users have the capability to immediately and permanently block any abusive user. Once blocked, that user's content will never appear in your feed again.
• Immediate Content Removal from Feed: When you choose to flag a post, the platform will immediately remove that post from your personal feed view dynamically to protect you from the offensive content.

6. Moderation and Enforcement

6.1 The 24-Hour Review Window

Heya actively monitors the platform and reviews user flags. The Developer commits to investigating all reported objectionable content and abusive behavior within 24 hours of submission.

6.2 Enforcement and Account Termination

If a user is found to have violated our Zero-Tolerance UGC Policy, Heya will act immediately by:

1. Permanently removing the offending content from the entire platform.
2. Terminating and banning the user who provided the offending content. Banned users may be permanently restricted from re-accessing the App via account termination, IP address tracking, or Device ID blacklisting to prevent re-entry.

By posting content on Heya, you grant Heya a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, display, reproduce, and distribute such content in connection with the operation and moderation of the App.

7. Prohibited Activities

The following activities are also strictly prohibited on Heya:

• Soliciting money, banking credentials, or financial information from other users.
• Sharing or transmitting explicit content or private media without the explicit consent of the subject.
• Using the App for commercial purposes, prostitution, or escort advertising without our express permission.
• Collecting personal information from other users without their consent.

8. Termination

Heya reserves the right to suspend or terminate your account at any time, for any reason, including but not limited to violation of this Agreement. Upon termination, your right to use the App will immediately cease.

9. Disclaimers

Heya provides the App on an "as is" and "as available" basis. We do not warrant that the App will be uninterrupted, secure, or error-free. We disclaim all warranties, whether express or implied, including but not limited to fitness for a particular purpose and non-infringement.

10. Limitation of Liability

In no event shall Heya be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, whether based on warranty, contract, tort, or any other legal theory.

11. Changes to the Agreement

Heya reserves the right to modify this Agreement at any time. We will notify you of any changes by posting the updated Agreement on the App. Your continued use of the App after any such changes constitutes your acceptance of the new Agreement.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.
